im just glad to see the site back up...

i was like everyone else wondering "what the hell did i post?"...

after re-reading the notice i determined the site was shut down itself... for whatever reason...

i kinda went with the unpaid bill take...lol

second time i was in a small panic thinking "this might be for good".. :( :( :(

Could the thread not come under copyright 'fair use' exeption for "criticism and review"?

I don't understand USA law but it seems lots of Youtubers getting away with it using that loophole
Like I said, I don’t know the specifics of the laws regarding copyright and the internet. Typically, if I recall, it only really applies if you are making money off the copyrighted property. But I could be dead wrong on that. This is a completely free site with not so much as even advertising allowed on it.

In my mom’s case, people were actually trying to sell copies of her artwork. That was a pretty simple one - clearly illegal. I wouldn’t think the images posted on this site would have the same rules applied.
 
I had a Chinese firework company steal my band logo before. They named their firework after us too. So I just posted the link to buy the firework and told people we had our own fireworks now, haha.
I believe logos are different. We filed for a trademark with both artwork and a slogan. They were both initially refused as “purely ornamental “ until we gave a detailed explanation of how they were being used and how they were instrumental to our business and offerings. They were then approved at some pretty substantial expense - at least to us starting a new business venture.
 
Is this something that could occur with other topics? Not understanding why it would be just applicable to one thread type.

I also want to mention that it's too easy to post an underaged picture if a person isn't careful - and I have had to warn someone on this site about that before, so it has happened - and that will get a site shut down quicker than the Flash running a forty time.

I don't care if y'all want to look at boob and ass pics, that's your prerogative. But I want this site to stay even more.

Those threads are the reasons the site was DMCA'd twice. Again, I don't care if you or anyone else want to look at boob and ass pics because I honestly don't give a shit what anyone's personal preferences are. I just don't want this site shut down permanently, and I mentioned it because there's been pics that I've had to report for possibly being underaged. It's too easy to make a mistake, and I don't know if this site would come back a third time if such a mistake happened.

You're asking if other threads would apply? That's very possible. But at the moment, those aren't the threads that got us DMCA'd. We know which threads did, and I feel it's too much of a risk.

Again, I don't give a shit if you wish to look at pics of hot women; I'm attracted to hot women as well, but I want this site to stay even more.

But I've said enough, and ultimately, it's the decision of the admins and mods, and I'll respect whatever decision they make because they've earned that right time and again.

I doubt boobs and booty is the reason.

First off - it wasn’t both threads. It was only the one. Second, I’m not going to go into all the details but this statement is inaccurate. It was only one photo in one thread and that’s as far as I’ll go. The details really don’t matter beyond that.

So let’s all let it go, not jump to conclusions, and before long, you’ll see what the plan is going forward.

Yes it can happen with movie clips and songs on youtube that we post as well.
Wouldn't the take down notice go to youtube since they're the ones hosting and sharing the content? If someone were to go through the song of the day thread they'd find a bunch of dead links for that very reason.

I'm pretty sure it would have to come from the person owning the copyright. It's unlikely anyone here owns the copyright.

So, in this scenario, a former member would have to contact the owner. But why would the owner care, unless it's paywalled or something they want removed from the internet? How did the former member know, is it a sting?

Wouldn't then the take down for pictures goto the picture hosting sites?

Also music companies and bands post their videos to their own accounts and have the right to do so. We then post stuff straight from their accounts.
